Introduction

As we recall, The Republic of South Africa —referring to Article II of the Genocide Convention–, stated that the crimes committed by the State of Israel “are genocidal in character because they are intended to bring about the destruction of a substantial part of the Palestinian national, racial and ethnical group. …”.

The acts outlined by South Africa “are all attributable to [The state of] Israel, which has failed to prevent genocide and is committing genocide in manifest violation of the Genocide Convention.  … “ (emphasis added)

Article II of the Genocide Convention reads as follows. It esssentially defines acts of genocide, all of which apply to Palestine.

Article II

In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:

(a) Killing members of the group;

(b) Causing serious bodily or mental harm to members of the group;

(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;

(d) Imposing measures intended to prevent births within the group;

(e) Forcibly transferring children of the group to another group.

The answer to this question is addressed in Articles III and IV of the Convention on the Prevention and Punishment of the Crime of Genocide. 

It is not solely Israel which is waging the genocide. Western governments have formally endorsed Israel. They have provided financial support as well as military aid. US-NATO is a partner of Israel in this criminal endeavour.

Western governments are routinly arresting citizens who are protesting against genocide. Millions of people throughout the European Union and around the World have expressed their solidarity with Palestine.

Article III: “Complicity in Genocide”

The Convention is very explicit: it defines the notion of complicity in Articles III and IV.

Article III

The following acts shall be punishable:

(a) Genocide;

(b) Conspiracy to commit genocide;

(c) Direct and public incitement to commit genocide;

(d) Attempt to commit genocide;

(e) Complicity in genocide.

Several NATO member states have collaborated directly with Israel’s IDF in military and Intelligence operations. They are complicit in the act of genocide.

Complicity is Punishable

Article IV is very explicit.

Article IV:  

“Persons committing genocide or any of the other acts enumerated in article III shall be punished, whether they are constitutionally responsible rulers, public officials or private individuals”.

In this regard, heads of State and heads of government who have formally endorsed the conduct of Genocide by Israel, are categorized as “Constitutionally responsible rulers” and “public officials”. The latter are “Complicit in Genocide” under Article III section e} and can be arrested under the clauses of Article VI

Complicity in Genocide is Punishable under Article V and VI

Article V: (see below). enact

“the necessary legislation to give effect to the provisions of the present Convention, and, in particular, to provide effective penalties for persons guilty of genocide or any of the other acts enumerated in article III”.

Under Article VI (see below), they are liable for arrest and punishment: “tried by a competent Tribunal…” 

Article VI

“Persons charged with genocide or any of the other acts enumerated in article III shall be tried by a competent tribunal of the State in the territory of which the act was committed, or by such international penal tribunal as may have jurisdiction with respect to those Contracting Parties which shall have accepted its jurisdiction.”

The Above Analysis of the Genocide Convention 

Providing the Peace Movement with the means to confront national governments and question their political legitimacy.

Legal procedures against politicians who are “complicit in genocide” under Article III (e) should be contemplated.

POTUS DJT–‘We’re going to take care of the Palestinians and make sure they’re not murdered’

US President Donald Trump insisted on Sunday that he is determined to buy and own the Gaza Strip, but said he could allow sections of the war-ravaged land to be rebuilt by other states in the Middle East.

‘I’m committed to buying and owning Gaza. As far as us rebuilding it, we may give it to other states in the Middle East to build sections of it; other people may do it, through our auspices, but we’re committed to owning it, taking it, and making sure that Hamas doesn’t move back.’

Trump made his remarks to reporters aboard Air Force One on his way to New Orleans to attend the National Football League Super Bowl championship.

He was referring to his plan to relocate all of Gaza’s population and rebuild the Strip to create ‘the Riviera of the Middle East.’

‘There’s nothing to move back into. The place is a demolition site. The remainder will be demolished. Everything’s demolished,’ he said.

Trump also said he was open to the possibility of allowing Palestinian refugees into the United States, but would consider such requests on a case-by-case basis.

‘We’re going to take care of the Palestinians and make sure they’re not murdered,’ he said.

Izzat al-Rishq, a member of the Hamas political bureau, condemned Trump’s remarks in a statement issued by the terror group. Hamas started the war with its onslaught of October 7, 2023, in which 251 were taken as hostages to the Strip.

‘Gaza is not a property to be sold and bought. It is an integral part of our occupied Palestinian land,’ and Palestinians will foil displacement plans, Rishq added.

Trump last week floated the idea of the United States taking over Gaza and engaging in a massive rebuilding effort.

His statement was vague on the future of Palestinians and it was unclear under what authority the United States would take claim of Gaza. Trump’s announcement drew immediate rebukes from several nations.

Earlier on Sunday, Israeli President Isaac Herzog said Trump was set to meet with Egyptian President Abdel-Fattah el-Sissi and possibly Saudi Arabian Crown Prince Mohammed bin Salman, although he gave no dates for the talks.

The comments, delivered in an interview with Fox News’ Maria Bartiromo, came in response to a question about Trump’s proposal to take over and redevelop Gaza.

Herzog did not say when or where the meetings would take place, nor did he discuss their potential content. He also noted that Trump is due to meet with Jordan’s King Abdullah in the coming days, which Jordan’s state news agency has already reported.

‘President Trump is due to meet with major Arab leaders, first and foremost the king of Jordan and the president of Egypt and I think also the crown prince of Saudi Arabia as well,’ Herzog said.

‘These are partners that must be listened to, they must be discussed with. We have to honor their feelings as well and see how we build a plan that is sustainable for the future,’ Herzog said.

Saudi Arabia has flatly rejected Trump’s Gaza plan, as have many world leaders.

Jordan’s King Abdullah plans to tell Trump during their planned February 11 meeting in Washington that the proposal is a recipe for radicalism that will spread chaos through the Middle East and jeopardize the kingdom’s peace with Israel, Reuters reported last week.

Trump floats plan to ‘clean out’ Gaza and move Palestinians to Egypt and Jordan

Notice that Trump said nothing about Israel doing one single thing to stop the fighting in Gaza. Nothing about the tens of thousands of children killed…nothing.

US President Donald Trump has proposed a controversial plan to ethnically cleanse Palestinians from Gaza, suggesting that Egypt and Jordan accept them as part of a broader initiative to achieve “peace” in the Middle East.

The plan, described by Trump himself as a way to “cleanse” Gaza, has received immediate backing from Israel’s far-right National Security Minister Itamar Ben-Gvir and Finance Minister Bezalel Smotrich.

Trump, who referred to Gaza as a “devastated place,” claimed to have discussed the idea with Jordan’s King Abdullah II and planned further talks with Egypt’s President Abdelfattah El-Sisi.

Cats eat Palestinian corpses in Gaza amid devastating Israeli onslaught

Cats were seen eating the corpses of Palestinians in central Gaza amid a devastating Israeli incursion that has killed scores and blocked rescue workers from assisting victims. 

Footage posted on Sunday by local video creator Talal Mahmoud showed cats eating from bodies of Palestinians strewn on the streets near a UN-run school in the Nuseirat refugee camp. 

Ambulances and first responders had been unable to reach many areas under attack due to the heavy Israeli bombardment in recent days. 

The Gaza-based government media office on Monday condemned the ‘horrific war crimes’ committed by Israeli forces in its latest ground assault on the Nuseirat camp, which local media said began on the weekend. 

The media office said 17 tanks and other military vehicles stormed the camp under the cover of drones and air strikes. 

The ‘brutal assault’ murdered at least 50 people and left 20 homes destroyed or severely damaged, the office said in a statement. 

‘We strongly condemn the savage aggression carried out by the Israeli occupation forces against the New Camp in al-Nuseirat,’ it added. 

‘This attack is part of a broader campaign of genocide, systematic killing, total destruction, and forced displacement of civilians.’

As Nuseirat was being heavily attacked, Israeli drone strikes hit makeshift camps for displaced people in the so-called ‘humanitarian zone’ west of Khan Younis late on Sunday, killing 11 people.  

Another air strike killed at least five people securing the delivery of aid trucks near the ‘humanitarian zone’ in Rafah.

‘We were sitting in our tents when missiles suddenly started raining down on us,’ Rizq Ashour, 53, a survivor of the bombing, told Middle East Eye. 

‘What do they want from us? They direct us to this safe zone and we come here then they bomb us,’ he added.  ‘They have no humanity.’ 

The Israeli military admitted bombing the makeshift camp in Khan Younis’s ‘humanitarian zone’, claiming they were ‘targeting a Hamas member’. 

Ashour said all of those murdered were civilians.  

Meanwhile, Israeli troops continued to besiege the Kamal Adwan hospital in northern Gaza as air strikes heavily pounded the area around it. 

On Monday, Dr Hussam Abu Safiya, director of the hospital, told MEE that on Sunday tanks and bulldozers approached the western gate under cover of heavy gunfire directed at the facility. 

Bombing did not stop throughout the night, he said, destroying homes and surrounding buildings. 

‘Bullets penetrated the intensive care unit, the maternity department, and the specialised surgery department,’ Abu Safiya explained. 

He added that one of the generators was targeted and completely put out of service. 

There are currently 91 hospitalised patients, including adults, children, and women inside the hospital, who are receiving only the minimum level of care possible, according to Abu Safiya. 

‘The bombing continues from all directions, affecting the building, the departments, and the staff,’ the doctor said.

‘This is a serious and extremely horrifying situation. The world must understand that our hospital is being targeted with the intent to kill and forcibly displace us.’

The death toll in Gaza is now over 45,300 since 7 October 2023, with more than 107,000 wounded, the Palestinian health ministry said on Monday. 

According to the UN, 70 percent of the victims are children and women.

Donald Trump Accused of Committing ‘Massive Crime’ With Reported Phone Call to Netanyahu

Donald Trump has been accused of violating federal law by allegedly calling Israeli Prime Minister Benjamin Netanyahu to discuss the ceasefire deal the U.S. is helping to negotiate between Israel and Hamas.

The former president allegedly made the call on August 14, according to Axios, which cited two unnamed ‘U.S. sources who were briefed on the call.’

The next day, however, Netanyahu’s office denied that the call took place. In a statement quoted by The Times of Israel, a spokesperson said: ‘Contrary to media reports, Prime Minister Benjamin Netanyahu did not speak yesterday with former President Donald Trump.’

It is unclear if a call between Trump and Netanyahu took place and Newsweek has contacted representatives of the former president for comment.

The Logan Act

If Trump did make the call, he would potentially be breaking the law as the Logan Act, enacted in 1799, prohibits unauthorized private citizens from negotiating with foreign governments on behalf of the U.S.

American Muckrakers, an organization that states it seeks to hold politicians and officials accountable, has filed a request with the U.S. Department of Justice and the U.S. Department of State.

Axios cited one source as saying that Trump’s alleged call was intended to encourage Netanyahu to take the ceasefire deal that was on the table. However, the unnamed source told the outlet that they did not know what the actual conversation was.

‘Massive Crime’

Netanyahu met with Trump at his Mar-a-Lago residence in late July, when the Israeli Prime Minister was in the U.S. to meet with President Joe Biden and Vice President Kamala Harris.

At a press conference last Thursday, Trump said of Netanyahu: ‘I did encourage him to get this over with. It has to get over with fast…Get your victory and get it over with. It has to stop, the killing has to stop.’

Status of Ceasefire Deal

It comes after Hamas said it had agreed to a ceasefire proposal presented by the U.S. but opposes what it argues are ‘new conditions’ added by Israel.

Senior Hamas official and spokesperson Basem Naim told Newsweek that Hamas ‘welcomed’ Biden’s announcement on May 31, along with a subsequent United Nations Security Council resolution endorsing it on June 11, and that the group ‘confirmed its readiness for immediate implementation and submitted its approval of the mediators’ proposal on July 2.’

Naim then accused Netanyahu of deliberately disrupting the process by conducting new attacks and seeking additional measures.

Despite this, on Monday, U.S. Secretary of State Antony Blinken said he had ‘a very constructive meeting’ with Netanyahu, who had ‘confirmed’ to him ‘that Israel supports the bridging proposal’ put forth by the U.S., Qatar and Egypt in a bid to push through the deadlocked negotiations.

Blinken added that ‘the next important step is for Hamas to say ‘yes.’
